What is Litigation?

Litigation is a term that describes the profession of arguing in Legal instances – Courts and other legal tribunals (Labor court, Rabbinic court etc.).

In the area of Litigation there are two kinds: Civil and Criminal. The civil Litigation also includes specialization in commercial Litigation. Commercial Litigation includes many areas such as financial lawsuits regarding debts and/or breach of contract in various areas (real estate, banking, trade etc.), tender law, shareholders disputes, corporates law and more.

Civil Litigation also includes, among others, legal disputes and law suits in Labor law (employee- employer), torts (road accidents, Bodily injury and more), insolvency bankruptcy & liquidation, wills and inheritances, slander and more.

Litigation skills are applicable in any case that reaches legal discussions where you need to be represented by a Lawyer that is proficient in the relevant legal procedures.

The work or the litigator includes preparing the case and laying out the right strategy – and that’s why it’s important to turn to a professional lawyer in an early stage, to get proper consolation regarding gathering evidence, the right way to handle the opposite side etc. The litigator will draft the pleadings to the court (such as statement of claim), assist in preparing the testimonies of his client on one hand, and will investigate the other side and his witnesses, on the other hand.

The litigator will argue his client claims to the court, in writing and orally, so he has to have the capability to create good communication between the players in the commercial trial, such as the witnesses, plaintiff and judge. All, in the best interests of his client.

Every legal area requires knowledge and expertise, and in commercial Litigation the lawyer needs vast understanding in the relevant laws to the dispute under discussion (for example, in corporate law he needs to master the Companies law- 1999).

Besides knowing the laws and understanding the legal situation, a good litigator enjoys a deep understanding of the business environment of his clients and their interests (and of the other sides in the case). He needs to recognize the best business outcome for his clients and find the best way to get it – an experienced lawyer is of significant value to his clients.
